I asked the Alabama Department of Conservation and Natural Resources about whether someone sited for fishing without a license is allowed to keep their fish. The following is their response:
Normally anyone who is cited for fishing without a license is not required to turn the fish he or she has in possession back into the water nor or they confiscated by the officer. The likelihood of the fishes surviving if they were released is small, and there is no reason to take them away from the fisherman for a minor offense. If the fisherman is over the limit, then the fish are taken for evidence or photographed and held.
