Yes, it is true that many of us have forgotten our license (that's why I have had a lifetime license for many years) and went fishing. Yes, that makes you a poacher, by the very definition of the word.
As for the matter of intent. What's that old saying "ignorance of the law is no excuse". Obviously, as in the Martens case, the warden will issue a citation even if you swear you have one but forgot it because the law also states that you must have it in your possession while fishing. The warden is also, by written law, supposed to confiscate the illegally taken fish.
As for the practice of allowing cited poachers to stay on the water after being cited. I would like to see the law that says that.
It is obvious, at least to me, that our enforcement officers have developed some very bad habits regarding enforcement of the law. Does that make it right? Does that make it the law? No on both counts.
