We must remember that in this country we are innocent until proven guilty. Most lawmen I know have explained that in many circumstances, they have the authority to decide when to issue warnings, make arrests, confiscate property, etc. as deemed necessary and within the limits of the law with respect to the alleged violation. We have very few laws, if any, that are exactly worded with offense versus consequence. The attitude of the suspect will also surely affect the path taken by the lawman in the execution of his duties. That idea delves into human frailties which show that no man is infallible, and that sometimes we all deserve a break. Let's be more eager to forgive than to prosecute.
