Any body of water that is flowing across property is public in Alabama, as long as you stay in the water and don't get out on the property. You can wade in, canoe in, use a flatbottom, swim, etc as long as you don't get onto the person's land/property (a man-made pond obviously doesn't flow across property). If you can get in and get out, without touching the ground, you're legal.
We go into there several times in the spring from Spring Creek, once the water is at full pool. It's full of crappie, but you can't get into there now, at winter pool. WAIT A MINUTE, on second thought, with the flooding conditions you wouldn't have any problem and I bet the water is clearing in there and warmer... See ya' in there!
