From: Coe CWCJr <cwcjunior@juno.com>

Craig Pyle has taken the position of FPS Product Manager and is much more open and accessible, at least so far, about what is being done with FPS.

The 7.2 (yep, they have named it now) update is targeted for 1Q2000. He denies that this is a delay from the previously announced 'target' date of February, simply stating that Jan, Feb, and Mar are 1Q.

If his openness continues and if FC continues to fix and update FPS, his presence will be very welcome.

Although a person might be able to locate a copy of just the Palm files, which was the only difference in the two versions of 7.3....

FC has changed the Terms and Conditions for their support forum usage and now claims all posts are copyrighted by them. Copy of the T&C file

Under Fair Use this exerpt:
· Franklin Covey retains the copyright on any information, statements, ideas, or postings herein. Any product suggestions or ideas submitted to this forum are, by posting, the property of Franklin Covey and the rights of the person making such suggestions are extinguished therein....
Emphasis added.

(Even the Past ones (from when their T&C's stated all posts were public and could be copied)!)

At least that is what it seems from their demand letter.

I will be cleaning up this forum (in their terms 'immediately'). If it is clearly their content (or a TS person's post) and I am the one that posted it here then I will honor their request to delete it from this forum.

If it is a users post from BEFORE they changed the T&C's (you cannot recall it once you place it in the public domain) it stays unless they specifically dispute that post. ;-)

If there IS a dispute, the user may repost an original, here.

Let me make sure I understand.

Anything I post or have previously posted becomes the property of Franklin Covey and I am not allowed to repost it here. What happens when a post is removed from the Franklin Web Board?

Was there ever a courtesy post on the forum in the announcements section that stated this change of conditions? When did the change occur?

Hmmm, let me posit a situation:

I am a writer for a newspaper, and write an article which is published, -or- I post comments on company XYZ's forum that states 'anything posted here belongs to us' etc.

Then, one month later, I repost my own words on the FC forum.

Therefore, someone else (besides me), "owned" the idea before FC. How can FC claim ownership? Does FC really have a legal leg to stand on here? How would XYZ and FC duke it out for a good idea I came up with and posted in both places? Would I get sued?

It sounds kind of shaky to me. If I were in FC's employ, that would be one thing. I am not.

Mike;

Very interesting that you phrased it that way - "If I were in FC's employ" - that is. Just before they sent the missile, they emailed me and asked me to send them my phone number... they wanted to discuss some "opportunities"!

I emailed them that I declined unless they wanted to be specific about the opportunity they wanted to offer.

Robert A. Whitman, the FranklinCovey chairman and CEO, was quoted as saying,"Outsourcing our technology and customer relationship management to EDS allows us to focus all of our resources on our core competencies learning and performance solutions. We expect to save more than $50 million by EDS maintaining our information services, warehousing and customer interaction centers. We also free up $15 million in assets and reduce our capital requirements for investing in those areas. Additionally, this agreement provides us with a very strong technology partner in the area of e-learning to create, expand and deliver our human capital solutions, giving us a competitive edge in the marketplace.''

Wow! Sounds just like what they said when they contracted Axiom Technologies to turn Ascend 5 into Ascend 97. Not that some of the ideas weren't good but the implementation problems and bugs have kept it going downhill ever since.

From that AXTECH (now called Knowledge Track Professional Services Group) site....
" Franklin Covey made a strategic decision to outsource the development of Ascend® so it could focus on marketing the product. Franklin needed to partner with a company that would keep Ascend® on the leading edge of technology while maintaining the level of quality to which its customers were accustomed. "Our core competency is in marketing and supporting quality training and time management tools for our customers," said Randy Linnell, Director of Technology Products at Franklin Covey. "We needed to partner with a company that has vast experience in developing leading edge software for a mass market."
