FOSTER AGREEMENT/RELEASE FORM

1. I/we agree to be solely responsible for any Scottish Terrier that we take on as a FOSTER case, and to indemnify and hold harmless Scottish Terrier Rescue, its agents, representatives, members, successors or assigns from any and all claims of liability for any conduct, behavior, damage or injury caused to any person, property or animal on or after the date of this agreement; from any claim or damages known or unanticipated resulting from any claim or damages arising by my/our fostership or control thereof, over said FOSTER dog.

2. I/we understand that Scottish Terrier Rescue makes no guarantees, claims or warranties about temperament, behavior or medical soundness to any dog we accept into FOSTER care. I/we understand that sometimes these FOSTER dogs come from unknown circumstances and backgrounds and as with any animal, their behavior can sometimes be unpredictable.

3. I/we understand that any Veterinary expenses that we incur without the prior written approval of Scottish Terrier Rescue, are ours and ours alone to be financially responsible for.

4. I/we agree to provide said FOSTER dogs with a temporary home for as long as necessary until said FOSTER dog is placed in a permanent home, or until such time that I/we are no longer physically or financially able to care for said FOSTER dogs.

5. I/we agree that if circumstances arise that proper care can no longer be given to said FOSTER dogs, that I/we agree to return said FOSTER dogs to the designated officer, agent or representative of Scottish Terrier Rescue, named here ____________________________________________ . That in no event will said FOSTER dogs be sold or relinquished by me/us to another person or placed in an animal shelter or humane society or turned loose to roam freely.

6. I/we agree to properly house, feed, water, exercise, care for and provide inoculations, heartworm care and other veterinary or supportive care as said FOSTER dogs require.

7. I/we will exercise proper control and restraint over said FOSTER dogs at all times and not allow the dog to run at large.

8. I/we agree that in the event that said FOSTER dogs are not spayed or neutered upon receipt that I/we will have said FOSTER dogs altered with or without the financial support of Scottish Terrier Rescue within 60 days of receipt, and that I/we will provide a representative of Scottish Terrier Rescue, ___________________________________ a veterinarian’s certificate as evidence of spaying or neutering. And that if said FOSTER dog is physically unable to undergo surgery during this time I/we will provide above representative of Scottish Terrier Rescue with a veterinarian’s statement detailing why said FOSTER dog is unable to undergo surgery and if or when the surgery will take place.

9. I/we agree that NO FOSTER dogs will EVER be used for breeding purposes.

10. I/we agree to notify a Scottish Terrier Rescue agent IMMEDIATELY if said FOSTER dogs are ever lost or stolen.

11. I/we will allow representatives of Scottish Terrier Rescue to check on FOSTER dogs and their environment at any time, and that if the foster placement is ever found to be detrimental to the FOSTER dogs health, physical or mental well being, Scottish Terrier Rescue reserves the right to remove said FOSTER dogs from foster placement until the situation is corrected or another foster home can be found.

In the event that any member of the Foster Home breaches any covenant or condition herein and incurs any legal costs, including any attorney’s fees, costs of litigation, including costs of deposition, witness fees for expert or non expert witnesses; or court costs; or any other expense in relation to the enforcement of any covenant or condition, the Foster Home signer’s shall be individually and jointly liable therefore to Scottish Terrier Rescue.
